The personal data we collect

We collect a range of personal data directly from you and, in some instances, from third parties. We have listed the kinds of personal data below so that you can understand what we hold.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data includes name, username or similar identifier, Civil Id number, photograph, signature, passport, national ID card and date of birth.
  • Contact Data includes address, email address and telephone numbers.
  • Financial Data includes bank account and payment card details.
  • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us or one of our subsidiaries.
  • Technical Data includes internet protocol (IP) address, cookies, your login data, browser type and version and other technology on the devices you use to access this website.
  • Profile Data includes your username and password, your interests, preferences, and feedback and survey responses.
  • Usage Data includes information about how you use our website, products and services.
  • Marketing and Communications Data includes information we receive through our communication with you, your preferences in receiving marketing from us and our third parties and your communication preferences.
  • Sensitive Personal Data that requires a particularly high level of care when processing due to its sensitivity. The sensitive data we process includes fingerprint information, criminal records, health and medical information and information pertaining to political exposure.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel a service you have with us, but we will notify you if this is the case at the time.

How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract, we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.
  • Where we collect your explicit consent.

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending direct marketing communications to you. You have the right to withdraw consent to marketing at any time by contacting us.

    • Banks and financial services companies and payment companies involved in processing payments made by you using our services.

    • The Central Bank of Kuwait (CBK) and other governmental bodies and departments where required to by law or an instruction of theirs including to comply with applicable regulations.
    • The Police or the courts in the event that we wish to take legal action.
  • Communications providers:
    • Marketing agencies, social media platforms and communications firms who operate our website and social media channels on our behalf.
    • Telecommunications firms who we use to contact you about your accounts and products and services you hold with us.
    • Telecommunications firms who may send direct marketing messages to you on our behalf.

    • Third party companies providing us with IT systems, application or IT support to maintain our systems.
  • Ancillary service providers:
    • Storage companies for archiving and destruction of your personal data once we have no need to retain it following delivery of products and services to you.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Purposes for which we will use your personal data

Many of our external third parties are based outside the EEA and/or Kuwait so their processing of your personal data will involve a transfer of data outside the EEA and/or Kuwait.

Whenever we transfer your personal data out of the EEA and/or Kuwait, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

How we protect your personal data

We treat the security of all data held by Bahrain Exchange Company with the utmost importance and that includes your personal data. We are ISO 27001 compliant and undergo annual certification. You can find information on the certification on the ISO website.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long we retain your personal data

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

  • No fee usually required You will not have to pay a fee to access your personal data or to exercise any of the other rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
  • What we may need from you We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data or to exercise any of your other rights. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
  • Time limit to respond We try to respond to all legitimate requests within 15 calendar days. Occasionally it could take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.
  • Complaints to the Data Protection Authority Further to the rights that we comply with above, you also have the right to submit a formal written complaint to the relevant Data Protection Authority if you have reason to believe that we have not complied with the data protection laws.

Glossary

Our lawful bases

Data protection laws applicable to Bahrain Exchange Company set out a number of requirements for legitimate processing of your personal data, these are often known as lawful bases for processing. These lawful bases are:

  • Contractual obligation – processing of personal data in order to implement a contract to which you are a party or, upon your request, to conclude a contract;
  • Legal requirement – processing of personal data to implement an obligation prescribed by the Law or implementation of a court order from a competent Court or the Public Prosecution;
